Welcome to the Mobbs & Co website (the website). The website is owned and operated by Radbold Pty Ltd ABN 68 010 909 118 on behalf of itself and its related bodies corporate. The Terms and Conditions and Disclaimer form part of these Terms and Conditions.

Mobbs & Co is a trading name of Radbold Pty Ltd. Any reference to Mobbs & Co (also to we, us and our) in these Terms and Conditions of Sale is a reference to Radbold Pty Ltd and its related bodies corporate.

Please read these Terms and Conditions of Sale carefully. You acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions of Sale.

Contract Formation

  • The display of information on the website about products and services does not constitute an offer from Mobbs & Co.
  • A purchasers request to purchase constitutes an offer to purchase from the customer to Mobbs & Co.
  • The contract is formed once Mobbs & Co confirm that payment has been accepted for that order

Risk of Loss
Title to the goods purchased on this website does not pass from Mobbs & Co to you until we have received payment in full for the goods. All items purchased from Mobbs & Co are made pursuant to a shipment contract. This means that the risk of loss for such items pass to you upon our delivery to the carrier or to you.

General Terms and Conditions of Sale

  1. No refund or exchange on any product except as required by law and as otherwise specified by the seller. If a refund is made, Mobbs & Co may, to the extent permitted by law, retain any fee it has charged.
  2. If a product offered by Mobbs & Co is not as described, your sole remedy is to return it in an unused condition.
  3. GST (Goods and Services Tax) will apply to all goods and services supplied through this website. Prices in this website include GST where applicable.
  4. Mobbs & Co makes no representations or warranties of any kind, express or implied, and disclaims warranties of merchantability and fitness for a particular purpose.
  5. Where permitted by law, we reserve the right to limit sales, including the right to prohibit sales to re-sellers.

Ordering goods

Prices of products placed in the 'shopping cart' but not paid for are also subject to change and you agree to pay the price current at the time of payment. While every effort has been made to ensure the accuracy of prices and information displayed on the this website, Mobbs & Co reserves the right to accept or reject your offer for any reason, including without limitation, the unavailability of any product, an error in the price or the product description posted on this website, or an error in your order. We may require additional verification or information before accepting any order.

Delivery or collection of goods

  • Mobbs & Co makes no warranties as to the availability of delivery services.
  • You have the right to arrange your own collection of goods purchased. You are required to produce proof of purchase at the arranged collection site.

Damaged goods

  • Orders are to be checked at time of delivery. Signing of the delivery docket will constitute acceptance of the goods.
  • If you arrange your own collection of goods you will be required to sign the delivery docket at the Mobbs & Co site arranged at the time of purchase. Signing the delivery docket constitutes acceptance of the goods.

Freight Charges

  • A handling and packing charge applies.
  • Mobbs & Co are unable to send any corrosive products through Australia Post.
  • Australia Post has weight and size restrictions on all parcels. Please refer to the current restrictions by contacting Australia Post.

Product Information and Availability

Mobbs & Co reserves the right to alter product specifications without notice.

Publishing information about a product on the website does not mean that the product is necessarily available for sale or in stock.

Governing Law
These Terms and Conditions will be governed and interpreted in accordance with the laws of Queensland, Australia. You and Mobbs & Co agree to submit to the non-exclusive jurisdiction of the courts of Queensland. If you choose to access this site from another location, you are responsible for compliance with applicable local laws.

Severability
If any part of these Terms and Conditions are or become illegal, invalid or unenforceable in any relevant jurisdiction, that or those provisions will be: (a) interpreted in that jurisdiction, as nearly as possible, to reflect the intentions of the parties; and (b) if necessary to maintain the effectiveness of these Terms and Conditions, be severed for the purposes of that jurisdiction, with the remaining provisions remaining in full force and effect.

Disputes
Any dispute relating in any way to this website or to products you purchase through Mobbs & Co shall be submitted to confidential arbitration in Rockhampton, Australia, except that, to the extent you have in any manner violated or threatened to violate Mobbs & Co´s intellectual property rights, Mobbs & Co may seek injunctive or other appropriate relief in any court in Australia, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing for an independent arbitrator. The arbitrator´s decision shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.
